Photographs refers to Printed photographs, slides, negatives or digital images.
1 - Sending & Return of Your Source Media.
You are advised to use a delivery service, requiring "signature on delivery", when sending your photographs to us. Depending on your instructions we will use Royal Mail Special Delivery, Royal Mail Recorded Delivery or Royal Mail Parcel Force (or an equivalent delivery service) providing signature on delivery, web-based tracking facilities and insurance. Any disputes regarding loss or damage of your goods during transit should be taken up directly with the delivering company
2 - Safety of Your Source Material.
In the unlikely event of us causing damage to or loss of any of your photographs, we will pay up to £50 compensation per £100. Note that this does not apply to photographs that have arrived in a damage condition.
3 - DVD Player Compatibility & Guarantees (Slideshows).
The DVD disks that we produce are high quality industry standard DVD-R or optionally DVD+R disks.
3.1 - DVD-R disks play in almost all DVD players these days (or DVD-ROM drive in PCs). However you should be aware that very old DVD players (manufactured before 2001) may not have the ability to play DVD Recordable formats. If in doubt you can obtain compatibility information by contacting your equipment reseller or manufacturer or visit www.dvdrhelp.com to assess compatibility prior to placing your order.
4 - In case of Problems with your DVD disc.
If the DVD disk we produced is not correctly recorded or your compatible DVD-R or DVD+R player is unable to play it then inform us within 7 days of receipt by writing to support@Photo2Digital.co.uk describing the problem and the make & model of your player. We will investigate immediately and if necessary will ask you to return the CD(s)/DVD(s) & reproduce your disc(s) free of charge. We cannot however be held responsible for damaged or mishandled discs. It is customer's responsibility to protect the supplied discs from scratches or other damages.
5 - Turnaround Time.
We aim to complete and dispatch your orders within 5 to 28 working days from receipt. Turnaround time may be subject to current workload and seasonal trends and may take longer than 28 days. Please enquire at the time of order.
6 - Your Responsibility.
Customer warrants that the photographs shall not be obscene or contain child pornography nor infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, and to comply with any current laws.
7 - Our Privacy & Confidentiality Policy.
7.1 - We promise to respect the privacy & confidentiality of your identity and audio visual material. We will not supply your contact information to any third-party companies unless you specifically ask us to.
7.2 - From time to time we may email you with special offers and other related news. However, you can remove yourself from our mailing list by simply replying to any sent message from Photo2Digital.co.uk and placing the word "REMOVE" in the subject line.
8 - Money Back Guarantees.
All "Money Back Guarantees" exclude any incurred delivery charges both inwards and outwards unless stated otherwise.
9 - Our Rights to update our web site, Information & Prices.
It is important for us to be able to alter our information and pricing at any time, in order to maintain our Low Cost positioning in the UK. We therefore reserve the right to modify our web site, service levels and prices at any time. We will however honour your order should it be placed up to 2 weeks after the change. We will apply either the price at the time of order or our new prices (whichever lower in your favour).
10 – Disclaimers.
We will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this Agreement.
11 – Currency.
All prices quotes are in UK Pounds unless stated otherwise. If you wish to pay in Euro or other currencies please contact us for applicable currency conversion rate at the time of placing the order.
12 - Methods and Terms of Payment.
All prices include VAT at current rate unless specified otherwise.
UK Cheques/Postal Orders: We currently accept Cheques or Postal Orders in GBP made payable to "Human Interface Ltd".
Foreign Cheques: Cheques in other currencies are accepted subject to bank surcharges of up to £10.00 depending on the currency.
Online Credit Card Payments: You can pay online by Credit Card using secure payment processing service offered by PayPal.
Credit/Debit Card Payments over the phone: You can pay over the phone by most major Credit/Debit Cards.
Online Banking: You may wish to pay by direct transfer from your bank to ours. Please contact us for our bank account information.
Business & Personal customers should note that, unless agreed otherwise in advance, all payments are required prior to dispatch of your photographs.
NOTE: Failure to settle the account within the terms of this agreement will lead to legal action unless you have provided us with reasonable explanation on any disputes in writing within 7 days of receiving your conversions. In case of failure to settle the account within 3 months of the invoice date, and without prior written agreement, Human Interface Ltd will assume ownership of the photographs as well as the full copyright of all the digitized material. The copyright ownership will grant Human Interface Ltd to publish or sell the physical or digital material to any third-parties at own discretion.
13 - Over-payments & Under-Payments.
Should your order be underpaid by less than £5 we will continue to carry out work on your order and will subsequently bill you for the additional payment.
For under payments above £5 we will contact you to obtain authorisation prior to working on your order.
Should you Over-pay us by £2.00 or more, we will offer you a credit equal to the amount over-paid for your next order. Alternatively you can request a cheque for the value of overpaid amount less £2.00 handling charge. We are unable to reimburse anything less than £2.00p.
14 - Orders without payment.
If you are not certain about the actual costs and/or delivery cost of your order you can still send your order to us without a payment. On receiving your order we will inform you of the actual cost of your conversions and will await your confirmation or payment prior to processing your order. This service is provided free and no surcharges are applicable unless you decide not to go ahead with the order. Please also note that should you decide not to go ahead with the conversion for any reason, you will be responsible for any delivery charges incurred for returning your photographs back to you as well as an administration charge of £5.00.
15 - Risk Free Delivery Services.
For additional safety of your valuable material we can offer you a risk free form of delivery for returning your photographs & digital images. This involves us returning your photographs and digital images in two separate consignments. First we send your digital images, once you have confirmed receipt we then send out your original material. This ensures that at least one good copy of your content is safe in one location and should reduce any anxieties you may have regarding the risk of loss during the actual delivery process.
15.1 - In the unlikely event that your digital images do not reach you we will reproduce your conversions from your original material absolutely free of charge (applies to deliveries within UK only).
15.2 - On receipt of your digital images you are required to confirm your satisfaction with the conversions by phone or writing to Photo2Digital.co.uk within a reasonable number of days of receipt (usually 7 days unless you are away).
15.3 - We will then dispatch your original material within 48 hours of your confirmation.
15.5 - These terms apply in addition to the normal terms and conditions of service.
